Beach House was originally constructed as residential living units and not as a place of lodging, hotel, motel or inn. Beach House was not constructed as a “place of public accommodation” or “place of lodging” as those terms are defined by the Americans with Disabilities Act (“ADA”). The property may be accessible to some individuals depending on their particularly disability and need for accommodation but we are far from fully accessible as may be required of a hotel, motel or inn under the ADA. Herein, we have attempted to identify and describe features at Beach House in enough detail to reasonably permit individuals with disabilities to assess independently whether the property meets their own accessibility needs. However, we cannot possible list each and every feature of every room, amenity, space or element applicable under the ADA.
